Terms & Conditions of Service

These Terms and Conditions of Service ("Terms") govern all diagnostic evaluations, maintenance contracts, mechanical equipment replacements, ductwork remediation, and emergency repair services performed by Comfort SOS Corporation ("Comfort SOS," "we," "us," or "contractor") for property owners, property managers, tenants, and commercial enterprises ("Customer" or "Client") throughout South Florida.

1. Diagnostic Protocols, Scope of Work & Authorizations

When a certified Comfort SOS technician arrives at the service address, our team executes a comprehensive mechanical and electrical diagnostic evaluation. This includes evaluating refrigerant circuit pressure, electrical amperage draw, capacitor capacitance, blower motor static pressure, and safety float switch status.

  • Diagnostic Fees: Diagnostic evaluation fees cover technician travel, specialized electronic diagnostic instruments, and comprehensive mechanical troubleshooting. Diagnostic fees are disclosed prior to dispatch and are payable upon completion of the diagnostic inspection.
  • Written Estimates: Before initiating any repair, component replacement, or system modification, our technician provides a clear, itemized digital estimate outlining parts, labor, refrigerant recovery, and warranty terms. No physical repairs or part installations proceed without the Customer's verbal or written authorization.
  • Additional Discovered Defects: HVAC and commercial refrigeration systems operate as interconnected pressurized circuits. If the repair of a primary failure (e.g., replacing a burnt capacitor) reveals a secondary dormant defect (e.g., an electrically grounded compressor or restricted thermostatic expansion valve), the technician will pause work, explain the findings, and present a revised estimate for approval before proceeding.

2. Florida Mechanical Licensing & Municipal Permit Compliance

Comfort SOS Corporation is fully licensed and insured pursuant to Florida Department of Business and Professional Regulation (DBPR) standards under State Certified Air Conditioning Contractor license number CAC1819197.

  • Mandatory Permitting: In compliance with the Florida Building Code (Mechanical Volume) and Miami-Dade / Broward municipal ordinances, all full central air conditioning replacements, condensing unit swaps, air handler replacements, and major duct renovations require an official municipal building permit and subsequent local building inspector sign-off.
  • Permit Administration: Comfort SOS manages permit filings, engineering calculations (Manual J heat gain/loss, Manual S equipment selection), Notice of Commencement documentation, hurricane tie-down strapping inspections, and final mechanical inspection coordination on behalf of the Customer. Permit filing fees and municipal administrative charges are itemized on project proposals.
  • High-Velocity Hurricane Zone (HVHZ) Standards: Outdoor condenser installations in South Florida must adhere strictly to Florida Building Code HVHZ requirements, including rated composite equipment pads, stainless hurricane hold-down brackets engineered for 175+ MPH wind loads, and weatherproof electrical disconnect boxes.

3. Warranty Coverage, Conditions & Limitations

Comfort SOS Corporation takes immense pride in our craftsmanship and delivers layered warranty protection on both mechanical parts and certified labor:

  • Manufacturer Equipment Warranties: New complete central AC systems (Carrier, Trane, Rheem, Lennox, Daikin, Goodman) typically include 10-year registered manufacturer limited parts and compressor warranties. Comfort SOS assists customers in registering new equipment with the manufacturer within the statutory 60-day window following final startup.
  • Comfort SOS Labor Warranties: New complete system replacements installed by Comfort SOS include our standard written labor warranty (as specified in your proposal agreement). Component repair services using OEM parts are backed by a 1-year parts and labor warranty on the specific component replaced.
  • Warranty Exclusions: Warranty coverage does not protect against external damage resulting from utility electrical surges, lightning strikes, hurricane flooding, vandalism, improper third-party modifications, neglected air filter replacements, or animal intrusion. Annual preventive maintenance is required by equipment manufacturers to preserve continuous factory warranty validity.

4. Emergency Dispatch, Scheduling & Access Terms

Comfort SOS provides priority emergency dispatch 24 hours a day, 7 days a week, 365 days a year across South Florida.

  • Arrival Windows: Arrival windows are provided in good faith. During severe weather events, hurricane recovery, or extreme heat emergencies, dispatch timing is prioritized for vulnerable residents (elderly, infants) and critical commercial refrigeration failures (restaurants, food markets).
  • Safe Property Access: The Customer is responsible for ensuring clear, safe access to the indoor air handler (attic crawlspaces, mechanical closets) and outdoor condensing units. Pets must be secured, and electrical main breaker panels must remain accessible during diagnostic testing.

5. Payment Terms, Financing & Governing Law

Payment for diagnostic fees and repair services is due immediately upon completion of service. For complete HVAC system replacements or major commercial installations, payment terms follow the milestone schedule outlined in the accepted project agreement (e.g., initial deposit for equipment procurement, balance due upon final startup and permit inspection completion).

We accept all major credit cards, bank electronic payments, and approved consumer financing plans. These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida. Any legal proceeding arising out of or relating to services rendered shall be instituted exclusively in the state courts of Miami-Dade County, Florida.
